Marijuana Rule: PASSED!
on June 8th, 2018, your Board of Directors proposed a new and proactive Rule in light of the impending Marijuana Legalization. Your Board of Directors is very active and involved with keeping up with new laws and their impact on our Condo, as well as what expert opinion and suggestions are regarding the matter.
Our Board President, Andreea Birloncea, has been especially involved in communicating with our Legal Team (Deborah Howden from Shibley Righton) to ensure that we implement the best possible rules for our Residents. For months now, they have kept abreast of the Marijuana Legalization process and worked together to ensure that our Residents are protected from any unwanted effects of this legalization, such as odors seeping in to the common areas and/or other units.

As you can see from the articles and our prior blog post, "'We’re not against marijuana use, we’re simply saying there are so many other options to get the effects of marijuana without inconveniencing your neighbour'” (Andreea Birloncea in Now Magazine). We considered this rule a priority due to the many complaints that we have already been receiving throughout the years - years during which the use of marijuana was illegal and yet still bothering other Residents.
As of July 8th, 2018, the Marijuana consumption rule for within the condo was passed without ANY residents contesting it or requesting a requisition meeting. As such, the following rule is now valid and being enforced going forward:
(a) Smoking is prohibited in all common element areas except as may be designated as a smoking area by the Board.
(b) Smoking marijuana on the property is prohibited, except as may be designated as a marijuana smoking area by the Board.
(c) Consuming marijuana in methods that do not infringe on the enjoyment of the Units or Common Elements by other Owners (or their respective families, guests, visitors, servants and persons having business with them) is permitted whereas deemed reasonable by the Board.
(d) Growing marijuana (plants) is prohibited on the property except in areas that may be designated by the Board.
